Amendments to the Motor Vehicles Act and Regulations Pertaining to Off-Road Vehicles


Helmet Requirements

  • Everyone under the age of 16 must wear a helmet at all times while operating or riding an off-road vehicle anywhere in the territory.
  • Helmets are required for everyone when travelling on a maintained roadway.


Licence, Registration and Insurance Requirements

  • When operating an off-road vehicle on a maintained roadway, or crossing over a maintained roadway,  you must have:
    • A valid driver’s licence
    • Vehicle registration
    • Vehicle insurance
  • Anyone who does not have a valid driver’s licence, registration, and insurance is not permitted to operate an off-road vehicle on a maintained roadway.

Off-Road Vehicle Safety tips


  • Wear a helmet at all times.
  • Do not drive while impaired.
  • Travel at safe speeds and obey posted speed limits both on roads and on trails.
  • Ensure that the off-road vehicle that you are using is the appropriate type for your size and age. An off-road vehicle is not a toy and should not be operated by anyone under the age of 16, unless it is specifically designed for them and used under adult supervision.
  • Ensure your off-road vehicle is in good working order and carry the emergency kit (i.e. have a spare drive belt, spark plugs, first aid kit and tow rope).
  • Ensure you read your owner manual for your off-road vehicle.
  • Never travel alone – always travel with another rider, tell someone where you are going, and when you expect to return.
  • Avoid driving on lakes and rivers.
  • Carry a winter survival kit, including a shovel and an avalanche beacon/locator kit.

Please note that individuals operating off-road vehicles within Whitehorse city limits must obey City of Whitehorse bylaws regarding snowmobiles and ATVs.
